The court said that after considering the facts and circumstances of the case, the petitioner is being granted bail. During the hearing on the bail application of the accused in the present case, the lawyer for the accused said that his client and the victim's family live in the same house. The victim's father had borrowed Rs.1 lakh 20 thousand from the accused in 2019. The accused asked the victim's father several times to return the money, but he did not return it. On the day of the incident, there was a fight between the accused and the victim's father over the same matter. Later, who was given the color of rape and his client was implicated in a false case. The accused accepted the condition of the court The defense counsel said that the accused is ready to live in a house 15-20 km from the area where the girl's family lives on rent. Additional Public Prosecutor AB Asthana opposed the bail plea on the grounds that the accused had serious charges under the IPC and the Poxo Act. The court granted bail to the accused on the condition that he would not go or live in the area where the victim lives. At the same time, the court has also instructed him not to contact the victim and his family members in any manner, not to threaten or influence the prosecution witnesses or to tamper with the evidence.

14 वर्षीय लड़की से बलात्कार के आरोप में गिरफ्तार आरोपी को अदालत ने जमानत देते हुए कहा कि पुलिस को घटना की जानकारी देने में एक दिन की देरी हुई। इतना ही नहीं इस मामले की जांच भी पूरी हो चुकी है। ऐसे में आरोपी को जमानत देने में कोई अड़चन नही है।रोहिणी कोर्ट स्थित अतिरिक्त सत्र न्यायाधीश राज रानी की अदालत ने आरोपी पूरन सिंह बिष्ट को 20 हजार रुपये के निजी मुचलके एवं इतने ही रुपये मूल्य के जमानती के आधार पर जमानत दी है। साथ ही अदालत ने आरोपी पर एक विशेष सशर्त लगाई है। अदालत ने कहा कि आरोपी पीड़िता के घर से स्थायी तौर पर 15 से 20 किलोमीटर की दूरी पर रहेगा। कभी पीड़िता के संपर्क में नहीं आएगा। अदालत ने कहा कि आरोपी 27 जनवरी 2021 से न्यायिक हिरासत में है। इस मामले में आरोपपत्र दाखिल कर दिया गया है। वहीं अदालत ने कहा कि इस मामले में एक पेंच यह है कि पुलिस को इस घटना की सूचना देने में एक दिन की देरी हुई। अदालत ने कहा कि मामले के तथ्यों और परिस्थितियों पर गौर करने के बाद याचिकाकर्ता को जमानत दी जा रही है।पेश मामले में आरोपी की जमानत अर्जी पर सुनवाई के दौरान आरोपी के वकील ने कहा कि उनका मुवक्किल और पीड़िता का परिवार एक ही मकान में रहता है। पीड़िता के पिता ने 2019 में आरोपी से एक लाख 20 हजार रुपये उधार लिए थे। आरोपी ने कई बार पीड़िता के पिता से रकम लौटाने को कहा, लेकिन उसने नहीं लौटाई। घटना वाले दिन इसी बात को लेकर आरोपी व पीड़ित के पिता के बीच झगड़ा हुआ था। बाद में जिसे बलात्कार का रंग दे दिया गया और उनके मुवक्किल को झूठे मामले में फंसा दिया गया।

आरोपी ने अदालत की शर्त मानी

बचाव पक्ष के वकील ने कहा कि आरोपी उस इलाके से 15-20 किलोमीटर दूर मकान में रहने के लिए तैयार है, जहां लड़की का परिवार किराये पर रहता है। अतिरिक्त लोक अभियोजक ए.बी. अस्थाना ने इस आधार पर जमानत याचिका का विरोध किया कि आरोपी के खिलाफ आईपीसी और पॉक्सो कानून के तहत गंभीर आरोप लगे हैं। अदालत ने आरोपी को इस शर्त पर जमानत दे दी कि वह उस इलाके में नहीं जाएगा या नहीं रहेगा, जहां पीड़िता रहती है। साथ ही अदालत ने उसे किसी भी तरीके से पीड़िता और उसके परिवार के सदस्यों से संपर्क न करने, अभियोजन पक्ष के गवाहों को न धमकाने या प्रभावित न करने या सबूतों से छेड़छाड़ न करने के भी निर्देश दिए हैं।
