दिल्ली हाईकोर्ट ने केंद्र सरकार को फटकार, जानिए क्या कहा

Kadilli High Court reprimanded the central government, know what it said The High Court has directed the Central Government to clarify why it cannot formulate a formula for determining the maximum retail price (MRP) of an oxygen concentrator. The court said that due to the non-determination of the price of the oxygen concentrator widely used in the treatment of corona infection, a large amount is being recovered from the people. The court gave this direction after the central government expressed its inability to fix the prices. A division bench of Justice Vipin Sanghi and Justice Jasmeet Singh said that we are asking the government not to fix its value in rupees or money, but to decide a principle on which the oxygen concentrators will be sold. The bench said that Sircar should understand when he will not intervene in an extraordinary situation like corona epidemic. The High Court has said that there should be a limit on the price of any product, because the price of anything cannot be unlimited. The court questioned that if a Chinese producer company says tomorrow that it will sell it at 5 times the price, will we allow it, it cannot be allowed in the interest of consumers and patients. The High Court stated in a stern tone that it is your responsibility as a government to decide that people are actually able to afford the product and they do not have to pay much more than their nose.

उच्च न्यायालय ने केंद्र सरकार को स्पष्ट करने का निर्देश दिया है कि वह आक्सीजन कंसंट्रेटर का अधिकतम खुदरा मूल्य (एमआरपी) निर्धारित करने के लिए एक फार्मूला क्यों नहीं बना सकती। अदालत ने कहा कि कोरोना संक्रमण के इलाज में व्यापक तौर पर इस्तेमाल होने वाले आक्सीजन कंसंट्रेटर का मूल्य तय नहीं होने से लोगों से इसकी अत्याधिक राशि वसूली जा रही है।

अदालत ने केंद्र सरकार द्वारा कीमतों को तय करने में असमर्थता जताने पर यह निर्देश दिया। न्यायमूर्ति विपिन सांघी और न्यायमूर्ति जसमीत सिंह की खंडपीठ ने कहा कि हम सरकार को इसका मूल्य रुपये या पैसे में तय नहीं करने के लिए कह रहे हैं, बल्कि एक सिद्धांत तय करने के लिए कह रहे हैं जिस पर आक्सीजन कंसंट्रेटर बेचे जाएंगे।

पीठ ने कहा कि सरकर को यह समझना चाहिए कि यदि वह कोरोना महामारी जैसे एक असाधारण परिस्थिति में हस्तक्षेप नहीं करेंगे तो कब करेंगे। उच्च न्यायालय ने कहा है कि किसी भी उत्पाद की कीमत की सीमा होनी चाहिए, क्योंकि किसी भी चीज की कीमत असीमित नहीं हो सकती। अदालत ने सवाल उठाया कि कल कोई चीनी निर्माता कंपनी कहेगी कि वह इसे 5 गुणा कीमत पर बेचेगी तो क्या हम इसकी अनुमति देंगे, उपभोक्ताओं व मरीजों के हित में अनुमति नहीं दी जा सकती। उच्च न्यायालय ने सख्त लहजे में कहा कि एक सरकार के तौर पर यह आपकी जिम्मेदारी है कि यह तय किया जाए कि लोग वास्तव में उत्पाद का खर्च उठाने में सक्षम हों और उन्हें अपनी नाक से ज्यादा यानी काफी अधिक कीमत का भुगतान नहीं करना पड़े।
