हाईकोर्ट ने किया बड़ा सवाल – टीका लगवाने में हर कोई चाहता है प्राथमिकता, फिर बाद में किसे लगेगा

मुख्य न्यायाधीश डीएन पटेल और न्यायमूर्ति ज्योति सिंह की पीठ ने कहा कि याचिकाकर्ता में जिस राहतों की मांग की गई है उसके लिए नीतियों का ड्राफ्ट तैयार करने की जरूरत है। यह अदालत के अधिकार क्षेत्र में नहीं आता। अदालत मात्र असाधारण मामलों में नीतिगत निर्णय लेने पर विचार करेगी।अदालत ने कहा कि याची वकील नाजिया प्रवीण ने टीकाकरण में पहली खुराक ले चुके लोगों को प्राथमिकता देने की मांग की गई है और ऐसी रियायत केवल मांगने से ही नहीं दी जा सकती। दिल्ली में यह आम चलन बन गया है कि कभी भी लोग अदालत में याचिका दायर कर टीकाकरण में प्राथमिकता मांगने लगते हैं। यदि सभी को प्राथमिकता दी जाए तो सवाल यह है कि फिर बाद में टीका किसी लगेगा। सरकार की अपनी खुद की भी प्राथमिकताएं हैं।वहीं एक मई से शुरू हुए टीकाकरण अभियान के संबंध में ऑर्डर दी गई खुराक की स्थिति के संबंध में जानकारी मांगने पर पीठ ने कहा कि ऐसी जानकारी सूचना के अधिकार के जरिए हासिल की जा सकती है। इसके लिए रिट याचिका या जनहित याचिका दायर करना सही तरीका नहीं है।अदालत ने टीके के वितरण के संबंध में नीति बनाने और कोविड-19 रोधी विदेशी टीकों के क्लिनिकल ट्रायल से छूट की अनुमति देने के अनुरोध पर कहा कि नीतिगत निर्णय क्षेत्र के विशेषज्ञों द्वारा लिए जाते हैं क्योंकि यह एक जटिल काम है। अदालत ने कहा कि याचिका में कुछ ऐसे मामले उठाए गए हैं, जिसके संबंध में पहले ही उच्चतम न्यायालय में सुनवाई चल रही है।अदालत फिलहाल केंद्र सरकार व दिल्ली सरकार को याचिका को बतौर ज्ञापन स्वीकार कर विचार करने को कहा है।
